HOUSE OF REPRESENTATIVES AMENDMENTS TO H.B. 2624

Strike everything after the enacting clause and insert:

"Section 1. Title 41, chapter 3, article 5, Arizona Revised Statutes, is amended by adding section 41-564, to read:

START_STATUTE41-564. Minimum law enforcement expenditure amount; determination; definitions

A. The economic estimates commission shall determine the minimum law enforcement expenditure amount required by article IX, section 26, Constitution of Arizona, for each county, city and town as prescribed in this section.

B. The commission shall:

1. Before April 1 of each year, determine and report to each county, city and town the following:

(a) The total of the population of each county, city and town as of July 1 of the prior year and the population of any areas annexed by each county, city and town. The population of any areas annexed after that date must be estimated as of July 1 of the prior year.

(b) The estimated change in the GDP price deflator used to determine the minimum law enforcement expenditure amount for the following fiscal year over the GDP price deflator used to determine the minimum law enforcement expenditure amount for the current fiscal year.

(c) The minimum law enforcement expenditure amount for each county, city or town for the following fiscal year.

2. Determine the minimum law enforcement expenditure amount for each county, city and town as follows:

(a) Determine the population of the county, city or town as of July 1, 2022.

(b) Determine the total population of the county, city or town as required by paragraph 1, subdivision (a) of this subsection.

(c) Divide the population determined in subdivision (b) of this paragraph by the population determined in subdivision (a) of this paragraph.

(d) Determine the estimated or actual GDP price deflator for the 2022 calendar year.

(e) Determine the estimated GDP price deflator for the calendar year immediately preceding the fiscal year for which the minimum law enforcement expenditure amount is being determined.

(f) Divide the GDP price deflator determined in subdivision (e) of this paragraph by the GDP price deflator determined in subdivision (d) of this paragraph.

(g) Multiply the base expenditures amount of the county, city or town by the quotient determined in subdivision (c) of this paragraph and multiply the resulting product by the quotient determined in subdivision (f) of this paragraph.

C. For the purposes of this section:

1. "Base expenditures" means  the expenditures made by the county, city or town for law enforcement services incurred in fiscal year 2022-2023.

2. "GDP price deflator" has the same meaning prescribed in section 41-563. END_STATUTE

Sec. 2. Title 41, chapter 7, article 10.1, Arizona Revised Statutes, is amended by adding section 41-1279.08, to read:

START_STATUTE41-1279.08. Uniform expenditure reporting system; minimum law enforcement expenditure amount

A. As part of the uniform expenditure reporting system prescribed in section 41-1279.07, For each county, city and town, the auditor general shall require the information necessary to determine the minimum law enforcement expenditure amount required by article IX, section 26, Constitution of Arizona.

B. The auditor general shall hold a hearing to determine if any county, city or town has failed to make the expenditures required by article IX, section 26, Constitution of Arizona.  If the auditor general determines that a county, city or town fails to meet the requirements of article IX, section 26, Constitution of Arizona, the auditor general shall notify the state treasurer of the amount by which the expenditures are below the minimum law enforcement expenditure amount.  The state treasurer shall withhold this amount from the distributions made to the county, city or town pursuant to section 42-5029 and redistribute the withheld amount to  the other counties, cities or towns, as appropriate, as prescribed in section 42-5029 without consideration of the county, city or town whose monies are withheld and redistributed. END_STATUTE

Sec. 3. Conditional enactment

This act does not become effective unless the Constitution of Arizona is amended by the vote of the people at the next general election by passage of House Concurrent Resolution 2028, Fifty-fifth Legislature, Second Regular Session."
